Counter-Notification Procedure
If you believe that material you posted was removed or access to it was disabled as a result of mistake or misidentification, you may submit a written counter-notification to our designated copyright agent. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed or to which access was disabled, and the location at which it appeared before removal or disabling
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, mailing address, telephone number, and email address
- A statement that you consent to the jurisdiction of a competent court, and that you will accept service of process from the person who provided the original notification or an agent of that person
Upon receipt of a valid counter-notification, we may reinstate the removed material after providing the original complainant with a copy of the counter-notification and a reasonable waiting period, unless the copyright owner files an action seeking a court order against the alleged infringer.
Repeat Infringer Policy
Prizebeacon maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A repeat infringer is any user who has been notified of infringing activity more than once or against whom we have received more than one valid takedown notice.
Limitations on Liability
Prizebeacon reserves the right to remove or disable access to any content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, we will also terminate a user's account if they are determined to be a repeat infringer.
Good Faith and Accuracy
Please be aware that submitting a notice of copyright infringement is a serious legal matter. Submitting a notice with materially false or misleading information may expose you to liability, including damages, court costs, and legal fees. If you are uncertain whether material infringes your copyright, we recommend seeking legal advice before submitting a notice.
Modifications to This Policy
