By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.

The platform is accessible globally and is designed to support learners across different time zones and experience levels.

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time without prior notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. Account Registration

4.1 Account Creation

To access certain features of the platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@prizebeacon.vip if you suspect any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to other users, us, or third parties.

You agree to use the platform only for lawful purposes and in a manner consistent with these Terms. You are permitted to access and use the platform for your personal, non-commercial educational purposes unless you hold a valid commercial licence or written agreement with Prizebeacon.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform and its content solely for your personal, non-commercial educational purposes.

7.3 User-Submitted Content

If you submit, upload, or post any content to the platform, including artwork, comments, or feedback, you grant Prizebeacon a worldwide, royalty-free, non-exclusive licence to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the platform. You represent that you own or have the necessary rights to grant this licence and that your content does not infringe any third-party rights.

8. Payments and Subscriptions

8.1 Fees

Certain features or courses on the platform may require payment. All fees are stated in the applicable currency at the time of purchase and are inclusive or exclusive of applicable taxes as indicated. You agree to pay all fees associated with your chosen plan or purchase.

8.2 Billing

If you enrol in a subscription, you authorise us to charge your nominated payment method on a recurring basis at the frequency stated at the time of purchase. Subscription fees are charged in advance for each billing period.

8.3 Refunds

Refund eligibility is subject to the refund policy displayed at the time of purchase. We reserve the right to assess refund requests on a case-by-case basis. Refunds are not guaranteed unless expressly required by applicable consumer protection law.

8.4 Price Changes

We may change our fees at any time. Where applicable, we will provide reasonable notice of any price changes before they take effect. Your continued use of the platform after a price change constitutes your agreement to pay the updated fees.

11. Disclaimers

The platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Prizebeacon disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any results obtained from using the platform will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Prizebeacon and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the platform.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the platform exceed the total amount paid by you to Prizebeacon in the twelve months preceding the event giving rise to the claim, or one hundred Australian dollars (AUD $100), whichever is greater.

You agree to indemnify, defend, and hold harmless Prizebeacon and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your infringement of any third-party rights.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through a notice on the platform. Your continued use of the platform after any changes take effect constitutes your acceptance of the revised Terms.

Upon termination, your right to use the platform will immediately cease. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the location of Prizebeacon's registered address. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published by us on the platform, constitute the entire agreement between you and Prizebeacon with respect to your use of the platform and supersede all prior agreements, representations, and understandings.
